Terms of Use
Last updated: October 22, 2026
These Terms of Use (“Terms”) govern your access to and use of Fluxo, an educational note-taking and learning application operated by Markiian Halabut (“Fluxo”, “we”, “us”, or “our”).
These Terms apply to:
- the Fluxo mobile application;
- the website at https://fluxo.today; and
- related accounts, subscriptions, features, and services.
By accessing or using Fluxo, creating an account, or purchasing a subscription, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use Fluxo.
1. What Fluxo Is
Fluxo is an educational software tool designed to help users capture what they learn, organize their notes, and review and practice that knowledge over time.
Fluxo may provide features relating to:
- writing and editing notes;
- organizing notes into spaces and folders;
- attaching images, photos, and files and importing documents;
- AI-generated summaries, quizzes, flashcards, and other practice materials;
- spaced review and practice;
- learning statistics, activity tracking, and streaks; and
- related organizational and study tools.
Fluxo is a study aid. It is not a school, a course provider, or an accredited educational institution, and it does not issue grades, certificates, or qualifications.
2. Eligibility
You must be legally capable of entering into these Terms under the laws applicable to you.
You must generally be at least 16 years old to use Fluxo.
If applicable law requires a higher minimum age or the consent of a parent or legal guardian, that requirement applies.
3. Your Account
Certain Fluxo functionality, including synchronization and AI features, requires an account.
You agree to provide accurate information and to keep your account credentials secure.
You are responsible for activity performed through your account unless it results from circumstances for which we are legally responsible.
You must notify us at fluxo.admin@gmail.com if you believe your account has been compromised.
You may not:
- impersonate another person;
- create an account using information you are not authorized to use;
- attempt to gain unauthorized access to another user’s account; or
- interfere with Fluxo’s authentication or security systems.
4. Your Content and Synchronization
4.1 How your content is stored
Content you create or add to Fluxo, such as notes, spaces, folders, images, photos, files, learning statistics, and generated study materials (“Your Content”), is stored on your device and synchronized with the Fluxo backend.
Synchronization allows you to access Your Content across your devices and keeps a server-side copy that can be used to restore it. Some features, including synchronization and AI features, require an internet connection.
4.2 Ownership
You retain ownership of Your Content.
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, and display Your Content only as necessary to operate, provide, secure, and improve Fluxo for you. This includes sending the relevant parts of Your Content to our service providers, such as AI providers and storage providers, when needed to provide the features you use.
This license ends when Your Content is deleted from our systems, except for copies that we must keep for legal reasons or that remain in technical backups for a limited period.
4.3 Your responsibility for Your Content
You are responsible for Your Content and for having the rights necessary to add it to Fluxo.
You may not use Fluxo to store, generate, or share content that:
- infringes another person’s intellectual-property, privacy, or other rights;
- is unlawful, fraudulent, or harmful;
- contains malware or code designed to damage or interfere with systems; or
- is used to abuse, overload, or circumvent the limits of Fluxo’s AI features.
5. Data Availability, Backups, and Technical Failures
We take reasonable measures to store Your Content securely and to keep the synchronization service available. However, Fluxo is provided on an “as is” and “as available” basis, and we cannot guarantee that Your Content will always be available, complete, or recoverable.
Your Content may be lost, corrupted, delayed, or temporarily unavailable because of circumstances such as:
- technical failures, outages, or data corruption on our servers or those of our infrastructure providers;
- errors or conflicts during synchronization, for example when the same content is changed on several devices;
- software defects;
- security incidents;
- loss, damage, reset, or replacement of a device before its changes were synchronized; or
- events outside our reasonable control.
To the maximum extent permitted by applicable law, we are not responsible for the loss of information resulting from technical failures on our servers or the other circumstances listed above.
You are responsible for keeping your own copies of content that is important to you.
6. Educational Tool, Not Professional Advice
Fluxo is an educational and organizational tool. It does not provide professional advice of any kind.
Summaries, quizzes, flashcards, review schedules, statistics, and other outputs provided by Fluxo are intended to support your learning. They are not a substitute for course materials, instructors, or qualified professionals.
We do not guarantee any particular learning result, including improved memory, exam results, grades, or certification.
You remain responsible for:
- verifying information that matters for your studies, work, or decisions; and
- obtaining advice from an appropriately qualified professional when necessary.
7. AI-Generated Content
Fluxo uses third-party AI providers to generate summaries, quizzes, flashcards, organization suggestions, and other content from your notes.
AI-generated content is produced automatically. It may be inaccurate, incomplete, outdated, or misleading, even when it sounds confident, and it may not reflect the meaning of your original notes.
You should review AI-generated content before relying on it.
Certain AI features may use AI credits included in your plan. AI credits have no cash value, cannot be transferred or exchanged for money, and may be limited, refreshed, or expire as described in the application.
We may change, limit, or discontinue AI features, the AI providers we use, or the number of available AI credits.
8. Subscriptions
Fluxo may offer free and paid features.
The features, price, billing period, and other material subscription information applicable to a purchase will be displayed before you confirm the purchase.
8.1 Apple App Store subscriptions
Subscriptions purchased through Apple’s App Store are billed by Apple and are subject to Apple’s applicable terms and policies.
Unless otherwise stated by Apple at the time of purchase, an auto-renewable subscription continues and renews for additional billing periods until cancelled.
You are responsible for managing cancellation through your Apple Account or the subscription-management functionality provided by Apple.
Deleting your Fluxo account or uninstalling Fluxo does not automatically cancel an Apple subscription.
Refund requests for App Store purchases must be submitted using Apple’s refund process and are subject to Apple’s eligibility rules and applicable law.
Fluxo does not control Apple’s decision whether to approve an App Store refund.
8.2 Google Play subscriptions
Subscriptions purchased through Google Play are billed through Google Play and are subject to Google’s applicable terms and policies.
Unless otherwise stated at the time of purchase, recurring subscriptions continue until cancelled.
You are responsible for cancelling a Google Play subscription through Google Play’s subscription-management tools.
Deleting your Fluxo account or uninstalling Fluxo does not automatically cancel your Google Play subscription.
Refund eligibility is governed by Google Play’s refund rules and applicable law. Depending on the timing and circumstances of a request, Google may handle the refund request directly or may direct the user to the developer.
Fluxo does not guarantee refunds outside the rights provided by applicable law or the relevant Google Play policies.
8.3 RevenueCat
We may use RevenueCat to manage subscription entitlements and synchronize purchase status.
RevenueCat does not replace Apple or Google as the billing platform for purchases made through their respective stores.
8.4 Trials and promotional offers
Fluxo may offer trials, discounts, or promotional subscription terms.
Specific conditions will be displayed before you start the offer.
Unless otherwise stated, a trial associated with an auto-renewable subscription may convert to a paid subscription when the trial ends unless it is cancelled before the applicable deadline.
9. Prices and Changes to Subscription Plans
Subscription prices may vary depending on:
- platform;
- country or region;
- currency;
- taxes;
- billing period; and
- promotional offers.
Any applicable price will be displayed before purchase.
Future subscription prices may change.
Where required, Apple, Google, or Fluxo will provide notice or obtain any required approval before a new price applies to an existing subscription.
10. License to Use Fluxo
Subject to these Terms, Fluxo grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to use the Services for personal or lawful internal purposes.
This license does not transfer ownership of Fluxo or any associated intellectual property to you.
Except where applicable law expressly permits otherwise, you may not:
- copy or redistribute the application or substantial parts of it;
- sell, sublicense, rent, or commercially exploit the software itself;
- reverse engineer, decompile, or disassemble Fluxo;
- attempt to discover source code through unauthorized means;
- circumvent subscription, licensing, AI credit, security, or access controls;
- interfere with Fluxo’s infrastructure; or
- use Fluxo for unlawful, fraudulent, or abusive purposes.
11. Intellectual Property
Fluxo and its associated:
- software;
- interfaces;
- visual design;
- branding;
- logos;
- text;
- graphics;
- documentation; and
- other original materials
are owned by or licensed to the Service Provider and are protected by applicable intellectual-property laws.
These Terms do not grant you ownership of any Fluxo intellectual property. Your Content remains yours as described in Section 4.
“Fluxo” and associated branding may not be used in a manner that suggests endorsement, sponsorship, or affiliation without authorization.
12. Third-Party Services
Fluxo may depend on or integrate with third-party services, including services provided by:
- Apple;
- Google;
- OpenAI;
- Anthropic;
- TypeSafe AI;
- Cloudflare;
- RevenueCat;
- Sentry;
- Google Analytics;
- Microsoft; and
- hosting or infrastructure providers.
Third-party services are governed by their own terms and policies.
We do not control third-party platforms and cannot guarantee their continuous availability.
Fluxo is not responsible for a third party’s independent acts or omissions except to the extent that applicable law provides otherwise.
13. Internet and Device Requirements
Fluxo keeps a copy of your content on your device, so you can view and edit notes offline. Some Fluxo features require an internet connection, including:
- authentication;
- account management;
- synchronization and backup of your content;
- AI features;
- uploading and downloading images and files;
- subscription validation;
- purchases;
- certain support functions; and
- software updates.
Changes made offline are synchronized when your device reconnects.
You are responsible for your device, internet connection, mobile data, roaming charges, and other third-party connectivity costs.
14. Application Updates and Changes
We may update Fluxo to:
- add or remove features;
- improve performance;
- fix errors;
- address security issues;
- comply with legal requirements; or
- maintain compatibility with operating systems and third-party services.
Older versions may eventually become unsupported, and an update may be required to continue synchronizing your content.
We do not guarantee that every version of Fluxo will remain compatible with every device or operating-system version indefinitely.
15. Account Deletion and Termination
You may initiate deletion of your Fluxo account through the application’s settings or contact us at fluxo.admin@gmail.com.
Deleting your account permanently deletes Your Content stored on our backend, as described in our Privacy Policy. Deleted content cannot be restored. Keep your own copies of any content you want to retain before deleting your account.
Deleting your account does not automatically cancel a subscription billed through Apple, Google, or another third-party billing provider unless this is expressly confirmed during the deletion process.
You should manage an active subscription separately through the applicable billing provider.
We may suspend or terminate access to online Fluxo services if you materially violate these Terms, misuse the Services, engage in fraud or unlawful conduct, compromise security, or where suspension is otherwise reasonably necessary to protect Fluxo or other users.
Where reasonably possible and legally appropriate, we will provide notice before termination.
Termination does not affect rights or obligations that accrued before termination.
16. Availability of the Services
We aim to provide reliable services, but we do not guarantee that Fluxo will be:
- uninterrupted;
- error-free;
- continuously available;
- compatible with every device; or
- free from all defects.
Services, including synchronization and AI features, may be temporarily unavailable because of:
- maintenance;
- software defects;
- infrastructure problems;
- outages;
- platform changes;
- security incidents;
- third-party failures, including failures of AI providers; or
- events outside our reasonable control.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Fluxo is provided on an “as is” and “as available” basis.
We do not make guarantees regarding:
- a particular learning outcome;
- uninterrupted availability;
- the permanent availability or recoverability of Your Content;
- the accuracy or completeness of AI-generated content;
- fitness for a particular purpose; or
- compatibility with every device or third-party service.
Nothing in these Terms excludes warranties, guarantees, or statutory rights that cannot legally be excluded.
18. Limitation of Liability and Data Loss
To the maximum extent permitted by applicable law, Fluxo and the Service Provider will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of or inability to use Fluxo.
Loss of data
To the maximum extent permitted by applicable law, the Service Provider is not responsible for the loss, corruption, or unavailability of Your Content resulting from circumstances such as:
- technical failures, outages, or data corruption on our servers or those of our infrastructure providers;
- synchronization errors or conflicts;
- security incidents that occur despite reasonable security measures;
- failures of third-party services outside our reasonable control;
- loss, theft, damage, reset, or replacement of a device before its changes were synchronized;
- deletion of content or of the account by the user or by another person with access to the user’s account or device; or
- failure to keep your own copies of important content.
Other limitations
To the maximum extent permitted by applicable law, we are not liable for losses resulting solely from:
- inaccurate information entered by the user;
- inaccurate or incomplete AI-generated content;
- reliance on Fluxo as a substitute for course materials, instructors, or professional advice;
- failures of third-party services outside our reasonable control; or
- unauthorized modification of the application or operating system.
Where permitted by law, our aggregate liability arising from the Services will not exceed the total amount you paid directly for Fluxo during the twelve months immediately preceding the event giving rise to the claim.
These limitations do not exclude or limit liability where exclusion or limitation is prohibited by applicable law, including liability that cannot legally be excluded for fraud, intentional misconduct, or other mandatory statutory rights.
19. Consumer Rights
Nothing in these Terms limits rights granted to you by mandatory consumer-protection law.
If a provision of these Terms conflicts with a mandatory legal right applicable to you, the mandatory right prevails to the extent of that conflict.
20. Indemnification
To the extent permitted by applicable law, you agree to be responsible for reasonable losses, claims, or expenses directly resulting from:
- your intentional unlawful use of Fluxo;
- fraud committed through your account;
- your material breach of these Terms; or
- Your Content infringing another person’s intellectual-property or legal rights.
This section does not require you to indemnify Fluxo for losses caused by Fluxo’s own negligence, unlawful conduct, or breach of these Terms.
Mandatory consumer rights remain unaffected.
21. Governing Law and Disputes
These Terms are governed by the laws applicable to the Service Provider, without overriding mandatory consumer protections that apply to you in your country of residence.
Any dispute will be resolved before a court or other forum having jurisdiction under applicable law.
Nothing in this section removes a consumer’s right to bring a claim before a court that has mandatory jurisdiction under applicable consumer law.
22. Changes to These Terms
We may update these Terms when necessary because of:
- changes to Fluxo;
- new features;
- changes to subscriptions or AI credits;
- changes to the AI providers we use;
- legal or regulatory requirements; or
- changes to third-party platforms.
The updated Terms will display a new “Last updated” date.
For material changes, we will provide additional notice where required by law.
Your continued use of Fluxo after updated Terms become effective constitutes acceptance only to the extent permitted by applicable law.
23. Severability
If any provision of these Terms is found invalid or unenforceable, it will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted.
The remaining provisions will continue in effect.
24. Entire Agreement
These Terms, together with the Privacy Policy and any purchase-specific terms presented to you, form the agreement between you and the Service Provider regarding Fluxo.
Platform-specific terms imposed by Apple, Google, or another billing provider may also apply to transactions processed through that platform.
